These Terms, together with the Return & Refund Policy and Privacy Policy below, govern your use of www.lsfab.com (the “Website”) and any purchase made from LS Fabrication (“Company,” “we,” “us,” or “our”). By placing an order or using the Website, you (“you” or “the Customer”) agree to be bound by these terms.

1. Return and Refund Policy

1.1 Eligibility for Returns

• Returned parts must be in new, unused, uninstalled, and resellable condition, in original packaging (for sheet metal products, this includes the protective film/layer).
• Items showing signs of installation, modification, machining, painting, drilling, damage, or wear will not be accepted for return or refund, at our sole discretion.
• Returns must be requested within 30 days of the original delivery date, unless otherwise approved by us in writing.
• Only regular-priced goods are eligible for refund. Sale, clearance, and discounted items are final sale, except where prohibited by applicable law.
• Custom, made-to-order, cut-to-order, or personalized items (including custom fabrication, custom-length sheet metal, and any item modified per customer specification) are final sale and non-returnable, except in cases of a manufacturing defect.

1.2 Requesting a Return

• Contact us at info@lsfab.com with your order number before shipping anything back. Returns sent without prior authorization may be refused or delayed.
• All return shipments must include a printed copy of the original purchase receipt or order confirmation showing the order number.

1.3 Shipping Requirements

• Returns must be sent via USPS to avoid brokerage fees, duties, or cross-border customs charges.
• Shipments sent via UPS, FedEx, DHL, or similar carriers that incur brokerage, duty, or customs fees will have those costs deducted from the refund. If such charges exceed the value of the return, we reserve the right to refuse the shipment.
• Return shipping costs are the customer’s responsibility, except where a return results from our error (wrong item shipped, defective product) or as required by law.
• We recommend insured, trackable shipping. Loss or damage in transit on a return is the sender’s responsibility — we cannot issue a refund without confirmed receipt of the goods.

1.4 Refund Processing

• Refunds are issued only after returned items are inspected and approved.
• Approved refunds are issued to the original payment method within 7–10 business days of approval.
• Original shipping costs are non-refundable.
• We reserve the right to issue store credit instead of a cash refund at our discretion, or to charge a restocking fee on accepted returns, where permitted by law.

1.5 Order Cancellations

• Orders may be cancelled within 24 hours of purchase, or before the order ships, whichever is earlier, by contacting info@lsfab.com. Once an order has shipped, it is subject to this Return Policy.
• We reserve the right to cancel or refuse any order at our discretion — including for suspected fraud, pricing or listing errors, or unavailability of stock — with a full refund issued for any amount charged.

2. Limited Warranty & Product Disclaimer

2.1 Limited Warranty

LS Fabrication warrants its manufactured products to be free from defects in materials and workmanship for [insert warranty period — e.g., 90 days] from the date of delivery, under normal use. This warranty does not cover:

• Damage from improper installation, misuse, modification, or normal wear and tear;
• Corrosion, rust, or finish degradation from environmental exposure;
• Parts installed on vehicles used off-road, in racing, or in a manner inconsistent with the product’s intended use;
• Third-party or dropshipped products, which are covered solely by the manufacturer’s own warranty, where applicable.

Our sole obligation under this warranty, at our discretion, is repair, replacement, or refund of the purchase price of the defective item.

2.2 Disclaimer of Other Warranties

Except for the limited warranty stated above, all products are sold “as is” and “as available,” without any other warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent permitted by applicable law.

2.3 Fitment Disclaimer

Products are described as compatible with specific vehicle eras, makes, and models based on manufacturer specifications and typical fitment. Due to variation between individual vehicles (prior modifications, non-factory parts, body damage, aftermarket alterations), exact fitment is not guaranteed. Customers are responsible for verifying fitment prior to purchase and, where applicable, prior to modification or installation. Custom fabrication or trimming performed by the customer voids eligibility for return.

3. Assumption of Risk, Installation & Product Liability

• LS Fabrication products, including but not limited to hood hinges, door and hood latches, tailgate hardware, and structural or load-bearing components, are intended to be installed by a qualified, experienced individual or professional fabricator/mechanic. Improper installation of hardware and structural components can result in component failure, property damage, or injury.
• Products are intended for restoration, fabrication, and off-road/show use. Use on public roads is at the owner’s own risk and responsibility for ensuring the vehicle remains roadworthy and compliant with applicable regulations.
• By purchasing and using our products, the customer assumes all risk associated with the selection, installation, and use of the product, and acknowledges that LS Fabrication has no control over how a product is installed, modified, maintained, or used after sale.
• To the fullest extent permitted by law, LS Fabrication, its owners, employees, and contractors shall have no liability for any injury to persons or damage to property arising from the ownership, possession, installation, or use of any product sold, and there is no basis for any claim, suit, or demand against LS Fabrication arising from such use.

3.1 Limitation of Liability

To the maximum extent permitted by law, LS Fabrication’s total liability for any claim arising from a purchase — whether in contract, warranty, tort, or otherwise — is limited to the amount paid for the specific product giving rise to the claim. In no event shall LS Fabrication be liable for indirect, incidental, special, or consequential damages, including lost profits, loss of use, or cost of substitute goods, even if advised of the possibility of such damages.

3.2 Indemnification

You agree to indemnify and hold LS Fabrication, its owners, employees, and contractors harmless from any claim, damage, liability, cost, or expense (including reasonable legal fees) arising out of your misuse of a product, improper or unlicensed installation, modification of a product, or violation of these Terms.

4. PROP 65 Warning

WARNING: Our products can expose you to chemicals including lead, nickel, and chromium, which are known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.p65warnings.ca.gov.

• Aluminum products: Most aluminum alloys used in our billet and sheet metal parts contain trace amounts of lead (typically under 0.1%). Aluminum in solid form is generally physiologically inert, but dust or fumes generated by cutting, grinding, drilling, or welding may pose a hazard if inhaled or ingested. Use appropriate ventilation and PPE when machining.
• Steel hardware (bolts, latches, hinges): Steel alloys may contain nickel and/or chromium, including in stainless steel components, both of which are known to the State of California to cause cancer and reproductive harm.
• Coatings, patina products, and finishes: Some finishing and patina products may contain chemicals listed under Proposition 65. Refer to the product’s Safety Data Sheet (SDS), where available, before use.

Note for internal use: California law generally requires a “clear and reasonable” Prop 65 warning to be provided before or at the point of sale — a warning on this policy page alone may not fully satisfy that requirement for California-bound orders. Consider also displaying a short warning on affected product pages and at checkout for extra protection.

5. Website & Order Terms

5.1 Pricing & Product Information

We strive for accuracy, but errors in pricing, descriptions, or images may occur. We reserve the right to correct any error and to cancel any order affected by a pricing or listing error, with a full refund of any amount charged.

5.2 International & Cross-Border Orders

Customers outside Canada are responsible for any customs duties, import taxes, or brokerage fees assessed by their country upon delivery. LS Fabrication is not responsible for shipping delays caused by customs processing.

5.3 Payment Disputes & Chargebacks

If you have an issue with an order, please contact us at info@lsfab.com before initiating a chargeback with your bank or card provider — most issues can be resolved directly and faster this way. Chargebacks filed without first contacting us, or filed in a manner we believe to be fraudulent or in bad faith, may be disputed with supporting evidence (order records, shipment tracking, communications), and we reserve the right to recover associated costs and fees.

5.4 Force Majeure

LS Fabrication is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including supplier delays, shipping carrier disruptions, material shortages, natural disasters, labor disputes, or other events of force majeure.

5.5 Product Reviews

By ordering through our Website, you consent to receive one email within two weeks of shipment inviting you to review your purchase. This is optional marketing communication, not a mandatory requirement.

5.6 Intellectual Property

All content on this Website — including product photography, descriptions, graphics, and layout — is the property of LS Fabrication and may not be copied, reproduced, or used commercially without our written permission.

6. Dispute Resolution

6.1 Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

6.2 Venue

Any dispute arising from these Terms or a purchase shall be resolved exclusively in the courts of Alberta, Canada, and you consent to the personal jurisdiction of those courts.

6.3 Class Action Waiver

To the extent permitted by applicable law, disputes shall be resolved on an individual basis, and you waive any right to participate in a class, collective, or representative action against LS Fabrication.

7. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
• Entire Agreement: These Terms, together with the Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and LS Fabrication regarding your purchase.
• Modifications: We may update these Terms at any time. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms. The version in effect at the time of your order governs that order.
• No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
